Ticketing Terms & Conditions

Event

1. These Terms & Conditions apply to your registration and participation at any Event held by, on behalf of, or, in conjunction with, UNSW (the Organiser).

2. You acknowledge that your participation at the Event may be subject to additional venue, ticketing platform, or digital platform terms, conditions, and policies and You agree to comply with the same. 

3. The Organiser reserves the right, with reasonable cause, to refuse entry or remove any person without entitlement to a refund, including any person who causes a disturbance, or refuses to comply with reasonable requests made by the Organiser.

Ticket Prices & Fees

4. For paid ticketed Events, you must purchase a ticket in order to enter the Event venue or digital platform. For free, ticketed Events, or free tickets for a paid Event, you must register for a ticket in order to enter the Event venue or digital platform. Tickets are issued in accordance with these Terms and Conditions, and are subject to any venue, ticketing platform, or digital platform terms and conditions.

5. Prices are in Australian dollars and, unless otherwise stated, include booking fees and GST where applicable. A transaction charge may apply at the point of sale. 

6. You are not permitted to enter the Event venue or digital platform without proof that you have a valid ticket. The Organiser may charge you a fee to replace your ticket. 

7. Where any concessional tickets are provided for an Event (for example, to UNSW students, staff or alumni or to concession card holders) the ticket holder must meet the eligibility requirements for that ticket and may be required to provide evidence of their eligibility prior to the ticket being issued and/or at the Event. In the case of UNSW students, staff or alumni, the required evidence is their UNSW Identification (zID). If a ticket holder fails to produce evidence of their status when asked, they may be denied a ticket or access to the Event, or may be required to pay the difference between the concessional price and the full ticket price at the Organiser’s discretion.

8. Allocated seating is not available with General Admission tickets and such tickets cannot be replaced if they are lost, damaged or stolen. 

9. For Events with allocated seating, the Organiser does not guarantee that your allocated seat will be available. Where the Organiser needs to allocate an alternative seat to you, it will use reasonable efforts to provide you with a comparable seat.

10. Latecomers may not be given access to the venue or digital platform unless there is a convenient break in the session, and for certain Events latecomers may not be admitted at all. 

11. Tickets may not be resold or offered for resale at a premium (including via online auction sites) either by the original purchaser, or any subsequent bearer, without the prior written consent of the Organiser. Tickets sold or offered for sale in breach of this condition may be cancelled without a refund and the bearer of such a ticket may be refused admission. 

Event Changes & Cancellation

12. You acknowledge that the Organiser, the Event and your participation at the Event, are subject to UNSW's policies as well as laws, government restrictions, and enforceable directives, which vary from time to time. You agree to comply with these and acknowledge that they may affect whether and how the Event will be run and/or your participation at the Event. 

13. The Organiser reserves the right change any aspect of the Event, including to cancel the Event, or add, withdraw, reschedule or substitute artists or speakers and/or vary advertised programs, prices, venues (including digital platforms) and seating (including to reduce the number of persons who may attend the Event). The Organiser will endeavour to provide you with notice of such changes. 

14. If the Organiser cancels the Event: 

a. the Organiser will refund the cost of your ticket (excluding any administration charges) to the original purchaser of the ticket; and, 

b. to the extent permitted by law, the Organiser excludes all liability arising out of, or in connection with, the Organiser cancelling the Event, other than the refund referred to in paragraph a. 

15. If there is a change or cancellation of artist or speaker, the Organiser will only refund your ticket if the original artist or speaker was billed as the headline or main attraction. 

16. If after registration you are no longer able to attend the Event, the Organiser asks that you advise the Organiser in writing as soon as practicable. The Organiser reserves the right not to provide a refund and retain the ticket price as a cancellation fee, but may in its discretion provide a refund in the event of proven exceptional circumstances as determined by the Organiser. 

Release

17. Views expressed by artists or speakers participating in, or sponsoring, the Event are not necessarily those of the Organiser. 

18. You participate in the Event at your own risk. To the extent permitted by law, the Organiser or its employees, contractors or agents (those indemnified), are not liable for any losses, damages, expenses, injuries or other claims in relation to your participation or attendance at the Event, except to the extent any such loss, damage, expense, injury or other claim is caused by those indemnified’s negligence or wilful misconduct. 

19. To the extent permitted by law, except for the Organiser’s gross negligence or wilful misconduct, the Organiser will not be liable for any injury, loss or damage suffered by you in connection with the Event and the venue, including liability for any injury, loss or damage caused by the Organiser or its employees, contractors or agents or resulting from any matter outside their reasonable control.

20. The Organiser’s services come with guarantees that cannot be excluded under the Australian Consumer Law. 

Participant Behaviour & Damage

21. The Organiser reserves the right to prohibit you from entering the Event venue or digital platform or to remove you from the Event if you breach any of these terms and conditions or your behaviour is deemed dangerous, inappropriate or disruptive. 

22. If your actions result in damage to, or the loss of, any property, you must pay the Organiser the full remediation cost. 

23. You agree to comply with all notices displayed at Events. You are not authorised to use any recording devices.

24. Unless authorised by the Organiser in writing, you must not conduct any commercial, political, soliciting, promotional, surveying, canvassing or demonstration activity at the event, nor collect contributions or distribute any material.

Privacy & Personal Information

25. All personal information will be collected in accordance with all relevant privacy laws in force from time to time including the Privacy and Personal Information Protection Act 1998 (NSW) as well as the UNSW Privacy Procedure of the Information Governance Policy and UNSW Student Privacy Statement and you consent to the Organiser collecting, storing, using and disclosing your personal information, including all of the information contained in the registration form, for the purposes of administering, promoting, and managing the Event and future Events, including updating your record in the Organiser’s database.

26. The Organiser may disclose your name, organisation and contact details to other organisers and/or partners involved in the Event (if any) and may use your personal information to contact you for purposes relating to the Event or to promote future events.  

27. The supply of your personal information is voluntary; however, if you do not provide it to the Organiser, you may not be able to purchase, register for, and participate in, the Event. 

28. You have a right to access your personal information held by UNSW. You can also request amendment to that information if you believe that it is incorrect or make complaints about the information handling practices of UNSW or breaches of your privacy by UNSW. The information you provide will not be retained for longer than necessary and will be managed in accordance with the University’s Privacy Procedure of the Information Governance Policy.

Use of Your Image

30. You acknowledge that the Event may be recorded or photographed. You consent to the Organiser and third parties permitted by the Organiser taking photographs and audio/visual recordings of you throughout your participation in the Event and agree that the Organiser may use the photos or recordings in their original or edited form in broadcasting or communicating the Event to the public and for future promotional and marketing purposes without further notice or compensation to you. 

31. If you are invited to submit pre-recorded content for an Event, you grant the Organiser an irrevocable, free, worldwide, sublicensable licence to use, reproduce, adapt, modify and communicate to the public that content and agree that the Organiser may use that content in its original or edited form, however it so wishes, including at or in relation to the Event, broadcasting or communicating the Event to the public, on its social media pages, and for any purpose, including future promotional and marketing purposes without further notice or compensation to you.

32. In providing your consent, you release and discharge the Organiser, its staff and its agents from any and all loss, damage, expense or claims that you may suffer or incur by the use by the Organiser or any third party permitted by the Organiser of the photographs and recordings and/or the content of the same photographs and recordings. 

Health & Safety

33. If you are attending the event as part of a group, as the primary ticket purchaser, you are responsible for knowing the contact details of all attendees in your group. In the event you are contacted directly by the Government, including the Department of Health, for the purposes of contact tracing, you must: 

1. make the contact details of your group available to the Government (if you have the consent of each group member to do so); or 
2. contact each member of your group, and request that they provide their contact details to the Government directly.

34. All attendees in your group, including yourself, must commit to stopping the spread of COVID-19. If at the time of the event, either you, or any other members of your group are feeling unwell or are subject to a self-quarantine or self-isolation period, you are not permitted to attend the Event.  

Pigeon Fool Event Terms & Conditions

35. Counterpilot wishes to advise that this performance uses artificial intelligence systems that involve third party cloud-based processes. During interactive components of the performance, your voice or answers may be captured and processed via various means for the purposes of the performance. Counterpilot ensures that any data captured for the performance is used only for the purposes of staging Pigeon Fool and is not retained, stored, shared or used by any third parties, or by Counterpilot outside the scope of the performance.

36. By purchasing a ticket for Pigeon Fool you acknowledge your participation is subject to these AI systems.
